Abstract
The rise in global migration has sparked debates on the relationship between immigration and terrorism. The perception of menace, influenced by factors such as memory, sociocultural differences, and political systems, has been a central theme in public debate. Spain has implemented anti-terrorist measures in migration and asylum laws to combat terrorism. The Schengen Agreement and the European Unique Act have been instrumental in coordinating the treatment of people crossing borders, aiming to prevent illegal immigrants and asylum seekers. The Spanish asylum law, created in 1984 and introduced in 2009, is a result of the incorporation of asylum within the EU. However, the effectiveness of these measures in combating terrorism remains a topic of debate. The process of migration involves introducing aspects of the enemy’s criminal law into immigration and asylum laws, creating a presumption of danger to foreigners perceived as enemies of the host community.
